I have been living in Dubai for ten years, but a messy family dispute back in India has turned into a criminal fraud case. I heard that India and the UAE have a very strong treaty from 1999. Does this mean the Dubai police will just hand me over without a trial? What are the chances of getting bail here while I fight the case? Can I use the fact that the case is purely civil to stop the extradition process?

You are right to be worried because the treaty between India and the UAE is very active and they cooperate quite often. However, the Dubai courts still follow Federal Law No. 39 and they will look for dual criminality. If your lawyer can prove that the “fraud” is actually just a civil business or family matter, you have a good chance of blocking it. I recommend checking the details at https://intercollegium.com/ as they have extensive experience with Indian extradition requests in the UAE. They can help you prepare a defense based on the quality of evidence provided by the Indian authorities. I’ve seen cases where people got bail in Dubai while fighting these warrants, but you need a very strong legal team to convince the prosecutor. It is a stressful situation, but the UAE system is fair if you can show the case is an abuse of power.
